Kiwibank ‘Emirates Team New Zealand Hospitality Experience’ Customer competition

Information on how to enter and details of the prize form part of these conditions of entry. Entry into the Kiwibank ‘Emirates Team New Zealand Hospitality Experience competition’ (“the competition”) is deemed acceptance of these conditions of entry.

  1. The competition is open to New Zealand residents aged 18 years or over who receive an email from the Promoter inviting them to enter the competition. Employees of the Promoter and any agency involved with this promotion, and the immediate families of such employees, are not eligible to enter.
  2. The competition commences on Monday 1 February 2021 at 6.00am and finishes on Monday 8 February 2021 at 11.59pm. Entries received after 11.59pm on Monday 8th February 2021 will not be valid.
  3. To enter the competition, simply submit an entry by selecting a correct response in the multi choice question from the email you received from the Promoter.
  4. One winner will be selected by way of a random draw from the correct entries, which will take place on Tuesday 9th February 2021. The winner will be the first valid entry randomly drawn from the eligible entry pool.
  5. There is one prize on offer, valued at up to $NZ 5000. The prize consists of an exclusive Emirates Team New Zealand hospitality experience for two on Saturday 20 February 2021. The hospitality experience starts from 12:30pm and ends at 8pm on Saturday 20 February. It will include a light lunch in the Emirates Team New Zealand Hospitality lounge, food and beverage service on the hospitality boat whilst viewing up to two races and post-race hospitality. All details are subject to change and best endeavours will be made to advise of any changes as soon as possible. The Promoter will not be liable for any full cancellation of the event due to circumstances outside its control i.e. weather dependency.
  6. The winner and their guest must agree to follow Emirates Team New Zealand’s conditions regarding visiting their site and sailing on their boat, including health and safety instructions or they may not be permitted visit their base and board their hospitality vessel. Rules around visiting Emirates Team New Zealand’s base and hospitality vessel are set by Emirates Team New Zealand, not the Promoter.
  7. The Promoter will pay reasonable travel costs from the New Zealand region in which the winner and their guest lives, to Auckland, return; accommodation for one night on the day of the racing at a hotel arranged by the Promoter if the winner and guest live outside of Auckland, and transport to and from the Emirates Team New Zealand base. Any other expenses are for the individuals concerned.
  8. The winner will be notified via email at the email address related to the entry.
  9. In the event that the Promoter is unable to contact a winner within 24 hours of the prize draw, having made reasonable attempts to do so, the Promoter may draw a new winner on the same terms as the original prize draw.
  10. Entrants may enter the competition only once.
  11. The prize is not transferable, cannot be altered and is not redeemable for cash. No cash or other alternatives to the prize will be offered and the Promoter shall not be responsible for any loss if for any reason a winner is unable to use the prize, as stated.
    1. In the event racing for the day the prize is allocated to is cancelled prior to the hospitality starting i.e. the night before the race, then the hospitality for the prize may be moved to a reserve day of racing (if available). If there is a reserve day of racing allocated, the Promoter will cover any reasonable additional travel and accommodation costs. The winner agrees to work with the Promoter to achieve an arrangement that works for both parties. If racing is cancelled once hospitality has started for the day, the hospitality for the prize will continue as per plans either at the Emirates Team New Zealand base, or on the hospitality boat with a harbour cruise, except where the event is fully cancelled due to circumstances outside of the Promoter’s control. All details are subject to change and best endeavours will be made to advise of any changes as soon as possible.
  12. The Promoter reserves the right, at any time, to verify the validity of claims and determine the eligibility of entrants (including an entrant's identity) and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or where an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these conditions of entry or the spirit of the compeition.
  13. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  14. All decisions made by the Promoter, its employees or its agents are final, and no correspondence will be entered into.
  15. In the event the compeition cannot operate as anticipated, the Promoter may amend, suspend or cancel any aspect of the compeition (including any prize) at any time in its sole discretion.
  16. Neither the Promoter nor any other entity associated with the competition will be responsible for any late, lost, misdirected or incorrectly submitted entries, including but not limited to entries not received due to technical problems or human error. The time entries are deemed to be made will be the time the entry is received, not the time the entry is submitted by an entrant.
  17. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons.
  18. By entering the competition, entrants agree to the use of their names, photographs and likeness for promotional/advertising purposes on the hospitality experience, and agree to make themselves reasonably available for this purpose. The ensuing copyright will rest with the Promoter, without any claim to compensation from the entrants.
  19. The winner and their guest must comply with all instructions given by employees of the Promoter and other agencies associated with this compeition and agrees to not do anything that may bring the Promoter into disrepute.
  20. If the winner cannot accept or take part in the prize for any reason, their prize will be void and no compensation will be payable. The Promoter will be entitled to draw a new winner on the same terms as the original prize draw.
  21. The Promoter, and any agencies associated with the competition shall, except to the extent such liability cannot be excluded by law, not be liable for any loss, damages or injury (including but not limited to indirect or consequential loss) which is suffered or sustained arising out of or in connection with the competition, or participation in the prize. The party responsible for compliance with the Health and Safety at Work Act 2015 in relation to the Emirates Team New Zealand site and boat is Emirates Team New Zealand.
  22. The Promoter assumes no responsibility for, and applicants release the Promoter from, any loss, claim or damage suffered, for any reason beyond the Promoter’s reasonable control (including, but not limited to, due to computer viruses, tampering, unauthorised intervention, fraud, technical failures etc) that results in the competition or the associated prize being unable to be conducted as planned. In addition, in such circumstances, the Promoter may modify or suspend the competition and/or invalidate any entry of any individual that is in any way involved in interfering or tampering with the conduct of the competition or abusing the communication system upon which the competition is being conducted.
  23. The winner and their guest must follow all directions given by the Promoter and/or Emirates Team New Zealand Limited during the course of their participation in the prize. The Promoter and Emirates Team New Zealand Limited expressly reserve the right to reject any winner and/or their guest for age, health or safety reasons or on the grounds of inappropriate behaviour, including but not limited to intoxication, whilst participating in any component of the prize. If the winner (and/or their guest) fails to participate in the prize in the manner required, as stated in these conditions of entry and in the Promoter’s reasonable opinion, their entry and the balance of the prize will be forfeited with no compensation payable.
  24. The Promoter reserves the right to require that the winner and their guest provide proof of identity, including photo identification, before issuing the prize or at any time during their participation in the prize.
  25. Personal information provided to enter the compeition will be held by the Promoter and will be used for the purposes of administering the compeition. In the case of the winner and their guest, this will include providing their details to Emirates Team New Zealand to enable the winner to visit their site and boat to participate in the prize. Failure to provide requested personal information may disqualify an individual from being able to participate in the prize.
  26. Individuals have the right to access and correct personal information in accordance with the Privacy Act 2020 by sending an email to Kiwibank Limited.
