Conditions of Entry
The Kiwibank “Better Together” Promotion (the “Promotion”) commences Thursday 26 November at 6:00am and closes on Sunday 20 December 2020 at 11:59pm (”Promotion Period”). Nomination entries received after 11:59pm on Sunday 20 December 2020 will not be valid.
The “Promoter” of the Promotion is Kiwibank Limited.
The Promotion is open to New Zealand residents aged 18 years or over. Employees of the Promoter and any agency involved with the Promotion, and the immediate families of such employees, aren't eligible to enter.
By participating, entrants agree to be bound by these Terms and Conditions.
To enter, nominations must be submitted by completing the online nomination form available through the Kiwibank website.
Nominators may only nominate a particular nominee once but may nominate more than one nominee. A nominee may be nominated more than once by separate nominators.
Any nominations that appear, in the judges’ view, to be false, misleading or inappropriate nominations will be disqualified.
The following nominations shall be deemed invalid:
incomprehensible or incomplete nominations;
nominations that infringe the intellectual property right of third parties or that are plagiarised; or
nominations that do not comply with these terms and conditions.
All nominations become the property of the Promoter.
All nominators and nominees must agree to a security clearance check to be undertaken before they are selected as winners.
The Nomination Process
A panel of judges appointed by the Promoter will review all nominations that are eligible for consideration, throughout the Promotion Period. The judges will assess the merits of each nomination and select six successful nominations. Winning nominations will be awarded at the discretion of the Kiwibank Better Together panel of appointed judges.
Nominations will be reviewed in two rounds during the promotion period. Round one involves nominations received during the period starting Thursday 26 November and ending Thursday 10 December 2020. Two winning nominations from this first round will be selected and the winners will be contacted by Monday 14 December 2020. Winning nominees and their nominator from this first round must be available to film on either Monday 21 December or Tuesday 22 December 2020. If they are not available, the Promoter reserves the right to select alternative winners.
Round two involves nominations received during the period starting Friday 11 December and ending Sunday 20 December 2020. Four winning nominations from this second round will be selected and the winners will be contacted by Wednesday 23 December 2020. Winning nominees and their nominator from this second may feature in a TVC and must be available to film on either Monday 18 January or Tuesday 19 January 2021. If they are not available, the Promoter reserves the right to select alternative winners.
If there are no nominations received during round two or the nominations received don’t result in four winning nominations, the panel of appointed judges will review nominations received during round one again to select four winning nominations.
The Promoter reserves the right to change the Promotion terms and conditions, as well as the nature, period, scope and any details or elements of the Promotion, or cancel the Promotion at any time, by giving notice to the participants via email or through published information that will be available here.
If the Promoter is unable to contact a winning nominee or nominator after three attempts, that win will be forfeited, and the judges will select another winning nomination in their place.
The Promoter’s decision and the decision of the judges is final on all matters relating to the Promotion including the eligibility of nominations and the nature of any winning nominations. No correspondence will be entered into.
In the event a winning nominee’s position has changed, for example, they have left the business the nomination related to, or in the opinion of the Promoter the reasons for the nomination are no longer valid in any way, the Promoter reserves the right to reassess the nomination or its selection of the nomination as a winning nomination.
There are six prizes in total. Each prize consists of a hospitality experience for the nominator and nominee of the winning nomination on one day of sailing, as part of the Prada Cup or the America’s Cup 2021 races to be held in Auckland.
The Prada Cup is held between 15 January-22 February 2021 and the America’s Cup is held between 6-15 March 2021. The hospitality day for each winning nomination will be determined at the time of notifying the winning nominator and nominee.
Dates for the hospitality prize cannot be changed or transferred. If the winning nominator and nominee are not available for the selected date, another winning nomination will be selected.
The Promoter will pay reasonable travel costs from the New Zealand region in which the winning nominee and nominator live, to Auckland, return; accommodation for one night on the day of the racing at a hotel arranged by the Promoter and transport to and from the Emirates Team New Zealand base. Any other expenses are for the individuals concerned.
The hospitality experience starts from 11:30am and ends at 8pm on each race day. It will include lunch in the Emirates Team New Zealand Hospitality lounge, food and beverage service on the hospitality boat whilst viewing up to two races and post-race hospitality. All details are subject to change and best endeavours will be made to advise of any changes as soon as possible. The Promoter will not be liable for any full cancellation of the event due to circumstances outside its control.
In the event racing for the day the prize is allocated to is cancelled prior to the hospitality starting i.e. the night before the race, then the hospitality for the winning nominations will be moved to a reserve day of racing (if available). If racing is cancelled once hospitality has started for the day, the hospitality for the winning nominations will continue as per plans either at the Emirates Team New Zealand base, or on the hospitality boat with a harbour cruise, except where the event is fully cancelled due to circumstances outside of the Promoter’s control. All details are subject to change and best endeavours will be made to advise of any changes as soon as possible.
No part of the prize is transferable, exchangeable, or redeemable for cash.
Obligations of Winning Nominations
Before entering a nomination, the nominator agrees to the following terms, and is responsible for obtaining the consent of the nominee and ensuring the nominee agrees to the following:
All nominator and nominees agree to be identified by name with their entry.
Winning nominators and nominees agree to participate in filming activity as required, any print, TV, social media, or photography or interviews about the Promotion. Actual activities will be at the Promoter’s sole discretion.
Winning nominators and nominees agree to the Promoter making use of their name(s) and/or photographs for publicity purposes as determined by the Promoter.
The Promoter will be entitled to unrestricted use of the images and video footage and rights to distribute, exhibit, license and use the material in any manner whatsoever.
Winning nominators and nominees must agree to follow Emirates Team New Zealand’s conditions regarding visiting their site and sailing on their boat, including health and safety instructions, or they may not be permitted to visit or to board. Rules around visiting Emirates Team New Zealand’s site and boat are set by Emirates Team New Zealand, not the Promoter.
If any nominee withdraws their agreement to the above obligations, or it comes to the Promoter’s knowledge that the nominator did not obtain the nominee’s agreement, the Promoter reserves the right withdraw the prize and select another winning nomination.
Personal information received from nominations will be held securely by the Promoter and used only in relation to the administration of the Promotion.
Personal information provided to enter the Promotion will be held by the Promoter and will be used for the purposes of administering the Promotion. This may include sharing nominations with any judges in the Kiwibank Better Together panel of appointed judges, who are external to the Promoter.
Kiwibank may use information provided via the nomination, about the business associated with the nominator and nominee, to provide information to the business about products and services Kiwibank thinks may be of interest to the business.
Individuals have the right to access and correct personal information in accordance with the Privacy Act 1993 by sending an email to Kiwibank Limited.
The Promoter and any agencies associated with the Promotion, shall, except to the extent such liability cannot be excluded by law, not be liable for any loss, damages or injury (including but not limited to indirect or consequential loss) which is suffered or sustained arising out of or in connection with the Promotion, or participation in the prize. The party responsible for compliance with the Health and Safety at Work Act 2015 in relation to the Emirates Team New Zealand site and boat is Emirates Team New Zealand.
The Promoter assumes no responsibility for, and applicants release the Promoter from, any loss, claim or damage suffered, for any reason beyond the Promoter’s reasonable control (including, but not limited to, due to computer viruses, tampering, unauthorised intervention, fraud, technical failures etc) this Promotion or the associated prize is not able to be conducted as planned. In addition, in such circumstances, the Promoter may modify or suspend the Promotion and/or invalidate any entries of any individual in any way involved in interfering or tampering with the conduct of the Promotion or abusing the communication system upon which the Promotion is being conducted.
Where goods or services are supplied by third parties, the Promoter does not warrant the quality of those goods and/or services or the suitability for a particular circumstance. To the extent permitted by law, the Promoter excludes liability for any loss suffered as a result of the use of those goods and/or services.
The Promoter assumes no responsibility for any failure to receive an entry as a direct or indirect result of a technical problem or any kind or internet malfunction. Entries are deemed to have been received at the time of receipt of transmission into the Kiwibank website database, not the time of transmission by the applicant.
These terms and conditions are to be governed by and construed in accordance with the laws of New Zealand.
